Maine Ignition Interlock Information

In the state of Maine, an ignition interlock device (IID) may be required for all alcohol-related Operating Under the Influence (OUI) convictions. The offender is responsible for all costs associated with the IID.

In the case of a first offense OUI in Maine, the offender’s license will be suspended for 90 days. The offender may be able to receive their driving privileges with the installation of an IID. The offender will also be required to serve a two day jail sentence, complete an alcohol/substance abuse assessment and education program and pay all applicable fees. If the offender qualifies for license restoration with an IID, they must file an Ignition Interlock Petition for with the Secretary of State and receive written approval prior to having the device installed.

In the case of a second offense OUI in Maine within a ten year period, the offender’s license will be suspended for three years. The offender may be able to receive their driving privileges with the installation of an IID. The offender will also be required to serve a seven day jail sentence and pay all applicable fees. An IID can be installed nine months after the beginning of the suspension period. If the offender qualifies for license restoration with an IID, they must file an Ignition Interlock Petition for with the Secretary of State and receive written approval prior to having the device installed.

In the case of a third or subsequent offense OUI in Maine within a ten year period, the offender’s license will be suspended for six years. The offender may be able to receive their driving privileges with the installation of an IID. The offender will also be required to serve a 30 day jail sentence and pay all applicable fees. An IID can be installed three years after the beginning of the suspension period. If the offender qualifies for license restoration with an IID, they must file an Ignition Interlock Petition for with the Secretary of State and receive written approval prior to having the device installed.
