New York Ignition Interlock Information

If you have been convicted of a DWI in New York, your license will be suspended. In the State of New York an ignition interlock device (IID) is now required for all alcohol-related convictions, including first-time convictions as well as all misdemeanor and felony driving while intoxicated (DWI) convictions. The IID must be installed and maintained on any and all vehicles the offender owns and/or operates and must be obtained from a service provider that is certified by the State of New York.

Sentencing in cases of DWI will include a requirement that offenders be monitored by the local probation department or, if the offender is placed on conditional discharge, the county ignition interlock program. There are three different classes of ignition interlock devices in the State of New York. Your monitoring authority will specify which class you need. Device classifications include Class I, Class II and Class III. All devices meet state and federal requirements for IIDs and have data reporting capabilities. Class I & II IIDs use photo recognition and Class II IIDs also utilize global positioning system, or GPS, to track the vehicle’s location; report data in real-time and restrict drive time capabilities. A Class III device adds the option of an Emergency Response Program (e.g.) for interception of a targeted vehicle during a rolling re-test failure. IIDs are classified by the Division of Probation and Correctional Alternatives.

Whether you have been ordered by the court or the New York DMV to install an ignition interlock device, there are several things you will need to do. You will need to pay all fines, fees and court costs, and make sure your vehicle is in good working order, including horn, battery and all electrical systems. Make any repairs necessary prior to installation IID. If you want to install an IID in a vehicle that is not in your name, you will need a notarized affidavit from the vehicle’s owner granting you permission to install the IID. Once you’ve completed these steps, you’ll need to gather the following information to provide to your IID company for installation:

  • Condition of Discharge, Probation Order or DMV Problem Driver and fax it to your IID provider. If you have been pre-sentenced you will need to provide their date of sentencing when calling to set up an appointment
  • A list of all drivers of the vehicle and a copy of their photo ID
  • The VIN number and license plate number of the vehicle you are installing the IID in
  • Your insurance information
  • Your probation officer's or monitoring authority's information
